Respondents Prayer : Petition filed under Article 226 of the Constitution of India

seeking a writ of Certiorarified Mandamus to call for the records of the 1st respondent culminating in the issuance of final show cause notice dated 10.01.224 bearing Ref.No. Na.Ka.212/2021/F-1-31 and quash the same and to direct the 1st and 2nd respondents to consider and pass orders on the statutory revision petition filed under Section 80A of the Tamil Nadu Town and Country Planning Act, 1971 and forbear the respondents from taking any coercive action during the pendency and till final disposal of the said revision petition.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This petition is not maintainable.

2. We are not inclined to entertain this petition for two

reasons. One is that petitioner has not disclosed and suppressed the fact that he had already approached this Court by filing a petition against the impugned notice and order having been passed by this Court on 30.07.2024. Secondly, once there is an interim order passed by this Court when the revision petition is pending, second petition on the same cause of action would not be maintainable.

3. If the grievance of petitioner is that the revision petition has not been disposed of finally till date, it is for petitioner to approach the concerned authority than coming to this Court. Thus, no relief can be granted in this petition.
