PRAYER: Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure to direct the respondents police not to harass the petitioners without any basis. For Petitioner :

ORDER

This criminal original petition has been filed to direct the respondents police not to harass the petitioners without any basis.

2.The contention of the petitioners is that the respondent police are unnecessarily harassing the petitioners. The first petitioner is an Agriculturalist and the Second petitioner is a School Teacher. Earlier there was a case pending against them in Crime No.107 of 2019, which was compromised and quashed the https://hcservices.ecourts.gov.in/hcservices/

same by this Court in Crl.O.P.No.31515 of 2019 on 22.11.2019. Now, a case in C.C.No.746 of 2020 is pending against them before the Judicial Magistrate No.V, Salem and the petitioners are appearing before the trial Court. The respondent police, for obvious reason, registered a case in Crime No.167 of 2021 for offence under Section 7 (1) (A) of the Criminal Law (Amendments) Act and the petitioners have been targeted. Hence, the above petition.

3.The learned Additional Public Prosecutor appearing for the respondents submits that both the petitioners are accused in C.C.No.746 of 2020 and in Crime No.167 of 2021, the first petitioner alone is an accused.

For the purpose of investigation, earlier they were called and enquired. Thereafter, they were not disturbed by the respondent police. The respondent police are surprised that without any reason, this petition has been filed. He further submitted that both the petitioners are not required in any enquiry for the present. 4.Recoding the same, the criminal original petition is closed.
