WP No. 28437 of 2022 Writ Petition filed under Article 226 of the Constitution of India, seeking to issue a Writ of Mandamus, directing the respondents to constitute a separate Board for conducting selection to the teaching posts viz., Assistant Professor in Higher Education like Government Arts and Science Colleges, Government Polytechnic Colleges, Government Engineering Colleges, Government College of Education Colleges as well as Government Universities, forthwith in consideration of representation submitted by the petitioners dated 01.10.2022 within a time frame to be fixed by this Court. By Mr. C.Kathiravan, Special Government Pleader for R4 COMMON ORDER These Writ Petitions have been filed seeking issuance of a Writ of Mandamus, directing the respondents to constitute a separate Board for conducting selection to the teaching posts viz., Assistant Professor in Higher Education such as Government Arts and Science Colleges, Government Polytechnic Colleges, Government Engineering Colleges, Government College of Education Colleges as well as Government Universities, in consideration of the representation submitted by the petitioners dated 01.10.2022, and consequently to direct the respondents to complete the process of selection to the post of Assistant Professor pursuant to Notification No.12/2019 dated 04.10.2019 issued by the fourth respondent, Teachers Recruitment Board, forthwith, within a time frame to be fixed by this Court.

2. After submitting for a brief while, learned Government Advocate appearing for the respondents 1 to 3 would submit that the petitioner may be directed to submit a fresh representation before the appropriate authority, inasmuch as the present representation has been addressed to the Chief Secretary, Secretariat, who is not the appropriate authority to consider the petitioner's request.

3. In view of the submissions made by the learned Government Advocate, the petitioners are granted liberty to file a fresh representation before the appropriate authority within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of such representation, the respondent concerned shall consider the same and pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks thereafter. It is made clear that this Court has not expressed any views with regard to the merits of the case.
