ORDER
This revision petition has been filed challenging the dismissal order dated 30.06.2025 passed in I.A.No.5 of 2025 in O.S.No.8075 of 2022 on the file of the XX Assistant City Civil Court, Chennai, in and by which the Government official concerned was sought to be impleaded as the 3rd defendant.
2. Since no adverse order is being passed against the respondents, notice to the respondents is dispensed with.
3. The case of the petitioner is that the School and Management/ the defendants in the suit were deliberately refusing to produce the mandatory school records which were relating to the employment and services, which were essential for adjudicating the issue that arises for consideration. Therefore, the petitioner has taken out an interlocutory application for impleading the Government official, so that the records can be produced, in order to enable the trial court to effectively decide the Page No.2 of 5
issue.
4. I have heard the learned counsel for the petitioner and I have also gone through the grounds of challenge and also the order of the trial court.
5. On a perusal of the order impugned, I do not find any perversity or infirmity in the order of the Trial court, dismissing the petitioner's impleading application and thereby, this Court is not inclined to interfere with the same.
6. However, as contended by the learned counsel for the petitioner, the suit cannot be effectively disposed of in the absence of the records which are vital and absolutely necessary for testing the respective contentions of the parties.
7. In view of the above, this Court grants liberty to the petitioner to Page No.3 of 5
take out applications for summoning the records from the concerned office.
8. With the above liberty, this Civil Revision Petition stands dismissed. No costs. Consequently, the connected Miscellaneous petition is closed.
