The Petitioner, who apprehends arrest at the hands of the Respondent police for the offence punishable under Section 399 & 402 of IPC in Crime No.369 of 2023 on the file of the Respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the Petitioner and four other accused gathered and prepared to commit robbery, when the Respondent Police went to the place of occurrence, they escaped from the Police, except A1, who gave confession statement. Hence the complaint. 3.Learned counsel for the Petitioner would submit that the Petitioner was falsely implicated in this case, on the confession statement of the coaccused and the Petitioner is an innocent person. Hence the learned counsel for the Petitioner seeks for grant of anticipatory bail to the Petitioner. 4.Learned Government Advocate (Crl. Side) would submit that the Petitioner along with other Accused prepared to commit dacoity and on seeing the police and other people they ran way from the scene of occurrence. He would further submit that the first accused was arrested and based upon his 1/ 3

confession statement, the Petitioner was implicated in this case. He vehemently opposed to grant anticipatory bail to the Petitioner. 5.Heard the learned counsel for the Petitioner and the learned Government Advocate (Crl. Side) appearing for the Respondent Police. 6.Taking into consideration the facts and the submissions made by the learned counsel on either sides and the nature and gravity of the offence and the fact that the investigation is at the preliminary stage, I am not inclined to grant anticipatory bail to the Petitioner.

7.Accordingly, this Criminal Original Petition is dismissed, with the liberty to the Petitioner to file fresh application. 20.09.2023 sai 2/ 3
