ORDER

This writ petition has been filed for issue of writ of mandamus directing the respondents to act upon the representation made by the petitioner on 19.06.2025, wherein, the petitioner is seeking for issuance of legal heirship certificate on the demise of his paternal uncle Mr.R.S.Bharath. 2.Heard Mr.B.Arul Murugan, learned counsel appearing on behalf of the petitioner and Mr.R.Neelakandan, learned Additional Advocate General appearing on behalf of respondents 1 to 3.

3/6 3.It is seen from records that the petitioner's paternal uncle was unmarried and his parents pre-deceased him. Thus, he did not leave behind any legal heir whose name can be included in the legal heirship certificate. 4.The petitioner wants the legal heirship certificate to be issued by indicating the name of the parents who have already died in order to enable the petitioner to move the concerned Court claiming for a right over the property left behind by the paternal uncle.

5.In the considered view of this Court, the legal heirship certificate is not issued for the purpose of claiming any right over the property. It is only in the nature of a relationship certificate. Therefore, if the petitioner wants to claim any right over the property, he has to independently file a suit before the concerned Court and seek for the relief and the Court will deal with the same in line with the personal law that governs the petitioner. The Civil Court is not bound by a legal heirship certificate and therefore, there is no need for the Civil

4/6 Court to insist for the production of the legal heirship certificate. This clarity will sufficiently take care of the grievance of the petitioner. 6.This writ petition is disposed of in the above terms. No Costs. 22-08-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes ssr
