ORDER

The Contempt Petition has been filed seeking to punish the respondents for willful disobedience of the orders passed by this Court in W.P.No.2348 of 2025 dated 31.01.2025.

2. This Court, by order dated 31.01.2025, had passed the following order:

"4. Considering the facts and circumstances of the case, a mandamus is issued to the respondents1 and 2, to conduct survey of the petition mentioned property. The petitioner shall submit all the relevant records to show his title to the property and the respondents shall, after issuing notice to the adjacent 2/5

land owners and interested parties, hold an enquiry and thereafter, proceed to pass orders either surveying and subdividing the property or rejecting the request. In the case of a rejection, a speaking order shall be passed. The aforesaid exercise shall be completed within a period of 8 weeks from the date of receipt of a copy of this order. "

It appears that pursuant to the orders of this Court on 10.06.2025, a notice of survey was issued by the Tahsildar to the petitioner herein who is the contesting respondent in the writ petition as well as the writ petitioner stating that he intended to visit and survey the lands in S.No.146/6A and 146/6B2 on 02.07.2025.

3. It is seen that the Deputy Surveyor has submitted a report dated 31.07.2025 stating that the lands in S.No.149/6B2 was measured in the presence of the parties. The statement of the petitioner herein has also been enclosed along with the documents that have been submitted before this Court. Ultimately, orders have been passed on 3/5

08.08.2025 stating that S.No.149/6B2 had been surveyed and demarcated after issuing notice to the parties, in compliance with the orders of this Court dated 31.01.2025.

4. The grievance of the petitioner is that the survey has not been conducted in respect of S.No146/6A. However, a perusal of the report and the statement clearly shows that though notice was issued to the parties in respect of two survey numbers, the survey has been done in respect of S.No.149/6B2 as per the directions of this Court in W.P.No.2348 of 2025.

5. Since the orders of this Court dated 31.01.2025 has been complied with, the contempt petition is closed. 15.12.2025 srn 4/5
