ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 6(4) TN Scheduled Commodities (RDCS) Order 1982, r/w 7 (1)(a)(ii) Essential Commodities Act, 1955 in Crime No.150 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the respondent police patrol in Erumapalayam main road, Salem Town at the time some information gathered that the petitioner kept the 36 bags of PDS rice each bag contained about 50 kg totally 1800 kg and 12 bag of Gothumai 600 kg in front of one Prakash house. The respondent police was reached the spot the petitioner left the bags. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Additional Public Prosecutor submitted that 2 previous cases pending against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case, 2 previous cases pending against the petitioner and it is similar nature, this Court is not inclined to grant anticipatory bail to the petitioner.
