ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus to direct the second respondent to register the General Power of Attorney dated 02.07.2025 for the land comprised in Ka.Sa.No.655, Old T.S.L.R.No.10/1 measuring an extent 2.18 acres and North side 1/2 share measuring an extent of 14 Acres on the basis of Applications dated 03.07.2025 and 04.07.2025 vide T.P.No.224938939.

3. It is submitted by learned counsel for petitioner that petitioner submitted General Power of Attorney dated 02.07.2025 before the second respondent and he was given a temporary T.P.No.224938939. However, the same was not considered. Hence, petitioner submitted an application dated 03.07.2025 to register the above General Power of Attorney. Since the said 2/6

application was not considered, the petitioner submitted another application dated 04.07.2025 to register the said General Power of Attorney. However, the same is kept pending. Hence, the petitioner has filed the present writ petition.

At the outset, it was submitted by the learned Special Government Pleader that it is not clear as to whether the petitioner had even presented the above General Power of Attorney dated 02.07.2025 before the second respondent although there is an averment in the affidavit that the General Power of Attorney was in fact presented on the very same day. On the other hand, he would submit that petitioner had not yet presented General Power of Attorney. If the General Power of Attorney dated 02.07.2025 is presented before the second respondent, the same would be registered, if it is otherwise in order. If, for any reason, the Sub Registrar is of the view that the registration ought to be refused, he would do so after assigning reasons, which was agreed to by the learned counsel for the petitioner.

In view thereof, if the General Power of Attorney dated 02.07.2025 was already presented, and the same is kept pending, the second respondent shall register the same, if it is otherwise in order, in accordance with law. If the General Power of Attorney is not yet presented, it is open to the petitioner to 3/6

present the General Power of Attorney dated 02.07.2025 before the second respondent. On such presentation, the respondent shall register the General Power of Attorney, if it is otherwise in order, in accordance with law. If for any reason, the second respondent refuses to register the General Power of Attorney, he shall assign reasons in the refusal slip/order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.

6. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
