O R D E R

This Criminal Original Petition has been filed to direct the respondent police to register the petitioner's complaint dated 28.02.2016.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.

3. On a reading of the complaint, it is seen that this petitioner and certain others had entered into a joint venture agreement with one M/s.Green Tree Homes Limited, Alwarpet, Chennai, sometime in the year 2011 and that, they had agreed to keep the original documents in a locker to be operated by the following persons :

Group A Group B P.Ravichandran M.Maraiman Dinesh Ethiraj Parthasarathy Shanthi Asokan Alan B C David N.Kannan Now, it is alleged by the petitioner that without his knowledge, the documents have been removed and therefore the police should investigate the case.

4. Even according to the admitted case, the name of the petitioner does not figure as a signatory for the purpose of opening the locker. If the other flat owners exceeded their jurisdiction in removing the document from the locker, an FIR cannot be registered against the Bank or the opposite party or M/s.Green Tree Homes Limited. It is for the petitioner to work out his remedy before the Civil Court. That apart, it is seen that 8 to 9 persons lead by an Advocate, have gone into the Bank and threatened the Bank officials, which is deprecated.

5. Hence, this Criminal Original Petition is dismissed with liberty to the petitioner to work out his remedy in the manner known to law.
