Mr.P.Elango, learned counsel for the first respondent submits that he has no objection for allowing the application, which has been filed seeking to dispense with the Notice under Section 80(2) of the Civil Procedure Code.

2. The second respondent has been duly served and his name is also printed in the cause list.

3. This Court is satisfied with the averments stated in the affidavit filed in support of the application, seeking to dispense with the notice under Section 80(2) of Civil Procedure Code.

4. Accordingly, this application is allowed. Registry is directed to number the suit, if it is otherwise in order.
