Mr.P.Saravanan, learned counsel appearing for the respondent submits that the respondent, being a complainant in a 138 case, which has been filed in the year 2019 is yet to see the colour of the coin. The respondent has been approaching each forum of the criminal courts and now, presently before this Court.

2. This Courts finds that on the submission of the petitioner, the petitioner already paid Rs.60,000/- during the pendency of the appeal and deposited a sum of Rs.90,000/- on 19.09.2024. Now the amount of Rs.1,50,000/- is available in the credit of S.T.C.No.2916 of 2019. The learned counsel for the respondent / complainant may be permitted to withdraw the same. The learned counsel for the petitioner has not opposed the respondent to receive the amount but, with condition that the withdrawal of the amount, subject to the outcome of the revision. The respondent to file a petition before the lower Court with an undertaking to receive the amount.
