Respondents Prayer : Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd respondent to consider the petitioner's representation dated 28.11.2020 on the basis of petitioner (NCO.CODE.X0140) dated 14.06.2016 in the assignment of physics jobs 1/5

ORDER

By consent of both the parties, this writ petition has been taken up for final disposal at the admission stage itself.

2. Mr.K.Karthik Jagannath, learned Government Advocate accepts notice for the respondents.

3. This writ petition has been filed for a Mandamus seeking for a direction to the 3rd respondent to consider the petitioner's representation dated 28.11.2020 seeking for employment pursuant to his registration with the Employment Exchange on 14.06.2016. The petitioner claims that he has studied B.Sc(Physics) and he has registered himself with the Employment Exchange. According to the petitioner, till date, he has not been offered any employment. In such circumstances, he has given a representation on 28.11.2020 to the respondents requesting them to consider him for employment. Since the representation has not been considered, till date, he has filed this writ petition.

4. Heard Mr.K.Prabhakaran, learned counsel for the petitioner and Mr.K.Karthik Jagannath, learned Government Advocate for the 2/5

respondents.

5. At the outset, the learned Government Advocate appearing for the respondents would submit that only based on a seniority, the petitioner's request for employment will be considered. He would further submit that as on date, there are no vacancy for providing employment to the petitioner. The said statement is recorded.

6. However, this Court is of the considered view that no prejudice would be caused to the respondents, if the petitioner's representation is considered on merits and in accordance with law, within a time frame to be fixed by this Court.

7. For the foregoing reasons, this Court directs the 3rd respondent to pass final orders on the petitioner's representation dated 28.11.2020 seeking for employment based on his registration with the Employment Exchange on 14.06.2016 on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

8. With the aforesaid directions, this writ petition is disposed of. No costs.
