ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303 of BNS, 2023 and Sections 21(1) & 21(4) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.26 of 2025 on the file of respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused cut the granite stones without any valid permission from the Government. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent raised objections stating that there are totally 4 accused in this case. The accused illegally cut and removed granite stones valuing more than Rs.51 lakhs from the government land.

5. Considering the nature of offence that it is a case of illegal mining and the granite stones valuing more than Rs.51 lakhs have been cut and

removed from the Government land, this Court is not inclined to grant anticipatory bail to the petitioner.
