Respondents Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying of issuance of Writ of Mandamus directing the respondents to issue patta to the petitioner for the property comprised in old Survey no. 30/1 part New Survey No. 69/21 of Chettiyar Agharam Village, Maduravoyal Taluk, Chennai District, measuring to an extent of 000116 Hectares.

O R D E R

The petitioner has filed this petition for issuance of writ of Mandamus directing the respondents to issue patta to the petitioner for the property comprised in old Survey no. 30/1 part New Survey No. 69/21 of Chettiyar Agharam Village, Maduravoyal Taluk, Chennai District.

2. The case of the petitioner is that he is the absolute owner of the property comprised in old S.F.No.30/1, part New S.F.No.69/21, Chettiyar Agharam Village, Maduravoyal Taluk, vide Sale Deed Doc.No.5266 dated 25.08.2020 and from the date of execution of the Sale Deed, the petitioner is in possession and enjoyment of the property. Thereafter, the petitioner made representation dated 11.09.2020 to the respondents to transfer a patta in the name of the petitioner. However till date, the patta was not issued to the petitioner and therefore, he is constrained to approach this Court by filing this writ petition.

3. The learned counsel appearing for the petitioner submitted that it would suffice if this Court issues direction to the respondents to consider his representation and pass appropriate orders for issuance of patta within a stipulated time frame.

4. The learned Additional Government Pleader appearing for the respondents submitted that the application of the petitioner will be considered in terms of Tamil Nadu Patta Passbook Act, 1983.

5. Considering the above facts and circumstances of the case, this Court directs the respondents to consider the application of the petitioner dated 17.09.2021 for issuance of patta in the manner known to law, within a period of six weeks from the date of receipt of a copy of this order.
