This Criminal Original Petition has been preferred seeking direction to the 1st respondent Police not to harass the petitioner in the name of investigation based on the complaint given by one Mr.Sunderesan (PACTC Bus Conductor), S/o. Ponnusamy, having his residence at No.5/116, Arkattan Kudisai, Munchoorpattu, Vellore District - 632 057, in Crime No. Not know of 2022 pending on the file of the 1st respondent Police.
2. The learned counsel for the petitioner would submit that he is being continuously harassed by the respondent Police in the name of enquiry conducted on the complaint given by one Sundaresan. The learned counsel further submitted that the petitioner has also given a complaint against the said Sundaresan and the same is pending for enquiry in C.S.R.No.550 of 2022. According to the petitioner, there is a money dispute pending between the petitioner and the defacto complainant and the same is given with criminal colour.
3. Mr.S.Santhosh, learned Government Advocate (Crl.side) takes 2/4
notice for the respondent Police and submitted that on the complaint given by the said Sundaresan, enquiry is being conducted in C.S.R.No.810 of 2022.
4. Considering the submissions made by both the counsels, I feel it is appropriate to conduct enquiry in both the petitions simultaneously. Accordingly, the respondent Police is directed to conduct enquiry in both the cases in C.S.R.No.550 of 2022 and C.S.R.No.810 of 2022 simultaneously and do the needful in accordance with law.
5. With the above direction, this Criminal Original Petition stands disposed of. No costs.
