Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondents 1 and 2 to ensure that those appointed as members of the Senate, Standing Committee on Academic Affairs, and Syndicate of the University, in their capacity as Principals of its affiliated colleges, are qualified to be appointed as Principals, and that the provisions of the UGC Regulations in respect of their qualification and tenure is strictly adhered to. ORDER

This Writ Petition has been filed seeking a direction to the first and second respondents to ensure that the appointments of the Senate members, Standing Committee on Academic Affairs, and Syndicate of the University, in their capacity as Principals of its affiliated colleges, are made strictly in accordance with the provisions of the UGC Regulations, with respect to their qualification and tenure.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. If the petitioner/Bharathiar University Teachers Association is genuinely aggrieved by the appointment of unqualified persons, it is always open to them to approach the competent authority and seek appropriate remedy in the manner known to law. Without availing such remedy, approaching this Court with the above prayer, that too by way of an association is not sustainable.

4. In view of the above, this Court finds no infirmity or illegality in

the action of the first and second respondents.
