This Petition has been filed seeking Succession Certificate with respect to the debts of D.Justin Devaraj, the father of the petitioner.

2. The first and third petitioners are his sons and the second petitioner is his daughter. D.Justin Devaraj died intestate on 12.08.2017. The mother Mrs.Joy Justin predeceased him and died on 07.11.1995. During evidence which was adduced by the third petitioner, Justin Johnson Monickaraj, the death certificate of D.Justin Devaraj was marked as Ex.P-1, the death certificate of Joy Justin was marked as Ex.P-2, the legal heirship certificate was marked as Ex.P-3, the post office account passbook was marked as Ex.P-5, the certificate issued by the Sub Post Master, Anna Nagar was marked as Ex.P-6, the consent affidavits of the first and second petitioners were marked as Exs.P-9 and P-10.

3. The learned counsel for the petitioners stated that in the said consent affidavit, the first and second petitioners had given their consent for Succession Certificate to be issued in the name of the third petitioner.

In view of the said facts and evidence and statement made, Succession Certificate is issued in the name of the third petitioner Justin Johnson Monickaraj with power to collect debts and to receive the interest as specified in the schedule and this Petition stands allowed. The third petitioner is directed to render accounts once in a year.
