Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus, directing the respondents police to cause the production of the body and petitioner's daughter namely Mrs.A.Velanganni Selvi D/o.Mr.D.Arokkiyasami now aged about 34 years before this Court and hand over her custody to me.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ of Habeas Corpus Petition has been instituted to produce the daughter of the petitioner, namely, Mrs.A.Velanganni Selvi, now aged about 34 years.

2.The learned Additional Public Prosecutor would submit that on an earlier occasion also the very same detenue was missing and she was secured by the Police and handed over to the petitioner. Again she left the home and a complaint was registered. It seems that the detenue has some issues with the family members and left the family.

3.Under these circumstances, keeping the Habeas Corpus Petition pending would do no service to the cause of justice. However, the Police may continue the investigation and in the event of tracing out the detenue, the same may be informed to the family of the petitioner without causing any undue delay.
