ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section Section 7, 20(2) of COTPA Act, 2003, and Section 275 and 123 of BNS in Crime No.370 of 2025, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner was in illegal possession of 445.560 kgs of banned tobacco products. Hence this case. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, sought for anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal side) reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioner. He submitted that there are totally 2 accused in this case and huge quantity of 445.560 kgs banned tobacco products seized from the petitioner and the case is under investigation.

5.Considering the facts and circumstances of the case that the petitioner is in possession of huge quantity of banned tobacco products and 2\4

the case is under the investigation. The petitioner's custody interrogation is necessary. At this juncture, this is not inclined to grant anticipatory bail to the petitioner.
