The petitioners who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 147, 341, 294(b), 323, 324 and 506(ii) of I.P.C, in Crime No.458 of 2023 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that due to previous enmity on 09.07.2023, the de-facto complainant while returning to his home at the time the petitioners along with another person have waylaid the de-facto complainant abused and assaulted him with iron rod and also intimidated with dire consequences. Hence the complaint. 3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioners. 4.Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the case in counter case is pending against the petitioners. Crl.O.P.No.21710 of 2023 RMT.TEEKAA RAMAN,J., nvi 5.Heard the learned Counsel for the petitioners and the learned Government Advocate (crl.side) and perused the materials available on record.
6.Taking into consideration nature and gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioners for the present, with a liberty to file fresh application after passage of time or change in circumstances.
