ORDER

This petition is filed to alter the charge in the case investigated by the respondent police for motor accident death. The petitioner herein has given a representation on 07.09.2023 to the Investigating Officer stating 1/4

that apart from the driver of the offending vehicle, he had no license to drive. The owner of the vehicle who knowingly permitted the offender should also been arrayed as an accused as per Section 180 of Motor Vehicles Act.

2. The learned Government Advocate (Crl.Side) submits that on receipt of the representation from the petitioner, Section 41A notice dated 05.10.2023 been given to him for appearance on 10.10.2023 to provide information which are in his knowledge, so that the Investigation Officer can act upon accordingly.

3. Since the representation been acted upon and the same is under investigation, nothing survives in this petition. Hence this petition is disposed of recording the status as informed by the learned Government Advocate (Crl.Side).
