These applications have been filed to set aside the order of abatement caused due to the death of the second applicant and to bring on record the proposed applicants 3 to 6 as applicants 3 to 6 in the Original Petition.

2. Considering the nature of dispute between the parties, the abatement is liable to be set aside and the proposed applicants 3 to 6 as the applicants 3 to 6 have to be recognized as the as legal heirs of the deceased second petitioner, to advance substantive justice.

Accordingly, these applications are allowed.

The applicants are directed to carryout amendment and file amended petition copy by 31.10.2023.
