Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to quash the proceedings of the Respondent dated 13.06.2016 in so far as it direct the petitioner to hand over the golden articles which are holding as holder for value, in connection with the Crime No.3 of 2007 pending investigation on the file of the Respondent Police. ORDER

This petition has been filed to quash the proceedings of the Respondent dated 13.06.2016 in so far as it direct the petitioner to hand over the golden articles in connection with the Crime No.3 of 2007 pending investigation on the file of the Respondent Police.

2. This petition has been filed by the petitioner as against the issuance of summons by the Investigation Officer to give the statement for production of jewels of the petitioner said to

have been received from the accused in Crime No.3 of 2007.

3. This Court is unable to understand how this application is maintainable. The Investigation Officer has a right to issue a notice to any persons for the purpose of investigation. Such process cannot be completely interfered by filing this application under Section 482 of Cr.P.C. Hence, this Court is not inclined to entertain this petition and the petitioner is directed to cooperate with the Investigation Officer. It is also stated by learned counsel appearing for the Public Prosecutor that Investigation is almost completed and final report is taken on file in C.C.No.149 of 2020. The said submission is recorded.
