D.SANGEETHA [RESPONDENT / INTERVENOR / DEFACTO COMPLAINANT] Petition praying that in the circumstances stated therein the High Court will be pleased to modify the order passed by this Hon'ble Court on 02.11.2021 only in respect of the condition imposed in Clause (a) to the limited extend of modifying as, on depositing the said amount of Rs.1,00,00,000/- (Rupees One Crore only) in Cr.No.70 of 2020 before the Judicial Magistrate No.I, Poonthamalee, the same shall be deposit till the disposal of the above Criminal Case and pass such further or other other.

Order: This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.PRAKASH Senior Counsel for M/S. RAMALINGAM AND ASSOCIATES, Advocate for the Petitioner and of MR.S.BALAJI, Govt. Advocate ( Crl. Side) on behalf of the Respondent and of M/S.NARAYANAN, Advocate for Intervener the court made the following order:- The present petition has been filed seeking modification in respect of the condition imposed in clause (a) of para 7 of the order dated 02.11.2021.

Upon hearing the learned counsel for the petitioner, this Court is of the opinion that no further modification is required in the said order passed by this Court, since the petitioner, on his own volition undertook to deposit the amount. Such being the case it is not open for the petitioner to contend that the condition is onerous and seek modification https://hcservices.ecourts.gov.in/hcservices/

Accordingly, the petition seeking modification petition is dismissed.
