ORDER

Heard Mr.Balan Haridas, learned counsel appearing for the petitioner and Mr.K.Venkatesh learned Government Advocate appearing for the second respondent.

2. The petitioner has filed this writ petition challenging the order passed by the second respondent dated 22.06.2004, pertaining to IFST deferral scheme granted to the petitioner. The petitioner sought for stay of impugned order and this court, while entertaining the writ petition, has passed an interim order on 17.08.2004, granting an order of interim injunction subject to the condition that the petitioner pays a sum of Rs.15,00,000/- (Rupees Fifteen Lakhs only) on or before 30.09.2004. Subsequently, when the stay petition came up for hearing on 31.07.2006, it was reported that the petitioner did not comply with the order and he is not pressing the miscellaneous petition. Accordingly, the stay petition was dismissed. Therefore, at this distance of time adjudicating the correctness of the impugned order would be merely academic, as there would have been several subsequent event.

3. Accordingly, while dismissing the writ petition, liberty is granted to the petitioner to work out their remedy under the provisions of the Act, if still there is a need to do so. No costs.

This Writ petition is dismissed with the above observation. No costs.
