As directed by this Court, the learned counsel for the applicants has effected Substituted Service on the proposed respondents in A. No.4854 of 2023. The Affidavit of Service along with the Paper Publication has been filed by the learned counsel for the applicants / plaintiffs. Despite effecting the Substituted Service, no one has entered appearance on behalf of the proposed respondent in A. No.4854 of 2023. Since no one has entered appearance on behalf of the proposed respondent, the proposed respondent is set exparte by this Court.

2. A. No.4854 of 2023 has been filed to implead the proposed respondent as 3rd defendant in the suit.

3. This Court after giving due consideration to the contents of the affidavit filed in support of A. No.4854 of 2023 is satisfied with the reasons given by the plaintiffs for impleading the proposed respondent as a party defendant in the suit.

4. The learned counsel appearing for the defendants 1 and 2 has not raised any serious objection for allowing this impleading application. Accordingly A. No.4854 of 2023 is allowed as prayed for and the proposed respondent is impleaded as 3rd defendant in the suit.

5. Fresh summons to the 3rd defendant returnable by 14.02.2024. Private summons are also permitted.

6. Post the matter on 14.02.2024.
