Alamelu v. The Inspector Of Police (Crime)
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 01.11.2022
CORAM:
THE HONOURABLE MS.JUSTICE R.N.MANJULA L.Alamelu ...
Petitioner versus The Inspector of Police, (Crime) N-2-Kasimedu Police Station, Chennai - 600 013.
(Crime No.57 of 2022) ...
Respondent PRAYER: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, praying to direct the respondent to file a final report in Crime No.57 of 2022 dated 16.03.2022 pending on his file. For Petitioner : Mr.T.V.G.Kartheeban For Respondent : Mr.S.Santhosh Government Advocate (Crl. Side) 1/4
O R D E R
This Criminal Original Petition has been filed to direct the respondent police to complete the investigation and file a final report in Crime No.57 of 2022.
2.
The learned counsel for the petitioner submitted that the petitioner has given a complaint against the accused on 16.03.2022 for the offence of cheating; but on the complaint given by the petitioner a case has been registered in Crime No.57 of 2022 by N-2-Kasimedu Police for the offences under Sections 406 and 420 of IPC.
3.
The learned Government Advocate (Crl. Side) appearing for the respondent would submit that a partial investigation has been completed and seeks short time to file the final report. 4.
It is seen that the complaint has been given as early as in the month of March 2022 and 7 months has lapsed already. However, considering the representation of the learned Government Advocate 2/4
(Crl. Side) appearing for the respondent that a partial investigation has been completed, I feel a time frame shall be fixed to complete the investigation and file the final report. It is worthwhile to mention that the accused, who has filed the anticipatory bail did not surrender before the Court and comply the condition imposed in the order of this Court dated 09.06.2022 in Crl.O.P.No.13253 of 2022. Since the accused did not surrender the Court and comply the condition, the bail also cancelled. Hence, the respondent police is directed to expedite the investigation and complete the investigation within a period of eight (8) weeks and file the final report. 5.
With the above direction, this Criminal Original Petition stands disposed of.
