Today, the matter has been listed under the caption "for being mentioned" at the instance of the learned counsel for the Applicant. 2.Both sides counsels present.
3.The learned counsel appearing for the applicant would submit that both parties have agreed for the visitation rights to be given to the applicant on the 1st and 3rd Saturday of every English Calendar month between 10.00 a.m. and 1.00 p.m. in the Child Care Centre, attached to the Family Court, Chennai, and on the 2nd and 4th Saturday of every English Calendar month between 10.00 a.m and 1.00 p.m. at Kapaleshwar Temple, Mylapore, Chennai. Whereas, due to oversight, the order of this Court dated 13.10.2025 in paragraph No.5, permission is granted to the applicant to visit the minor child only at Kapaleshwar Temple on every Saturday. 4.The learned counsel for the respondent is also present before this Court and expressed that he has no objection to effect the order to that extent.

In view of the fact, paragraph No.5 of the order dated 13.10.2025, passed in A.No.4109 of 2025 in O.P.No.438 of 2025 is modified as follows: "5.Considering the nature of relationship and the prayer sought for in the application, and since the respondent has also fairly conceded to produce the minor child at any public place, the applicant / mother is permitted to visit the minor child viz. Master K.E.Raghuram, at Child Care Centre, Family Court, Chennai, on the 1st and 3rd Saturday of every English Calendar month between 10.00 a.m. and 1.00 p.m. The applicant shall visit the child on every 2nd and 4th Saturday of English Calendar month, at Kapaleshwater Temple, Mylapore, Chennai, between 10.00 a.m. and 1.00 p.m. The respondent / father is directed to hand over the custody of the child to the applicant / mother to the aforesaid places without fail."

ORDER
This application has been filed seeking visitation right for the applicant's minor son K.E.Raghuram for 2 days in a week i.e. from Friday, Evening to Sunday Evening, pending disposal of the above Original Petition.
Learned counsel for the applicant would submit that the applicant is the mother of the minor child, who is aged about 5 years and was staying with her till April 2024. Thereafter the child was admitted in the School located near the residence of the respondent/father, taking advantage of the fact that the applicant was undergoing treatment, thereafter the respondent/father denied the applicant's access to her minor son and prevented all the communications. Earlier when the child was staying along with the respondent, he used to visit the applicant every week or at least every fortnight. Further on 22.05.2025 i.e. the minor child's 5th birthday, the respondent has not allowed the applicant to speak with the child and behaved rudely and indifferently. Thereafter the respondent sent legal notice dated 28.05.2025 calling upon the applicant for a mutual consent 4/7
divorce, which was suitably replied by the applicant vide her reply notice dated 25.06.2025. Hence now the applicant is before this court seeking visitation rights for her minor son for two days in a week. Learned counsel for the respondent would submit that the minor child is under the care and custody of the respondent/father and the child is very comfortable with the respondent/father, which should not be disturbed. However, the learned counsel for the respondent/father fairly conceded to produce the child weekly once at any public place. The main original petition is filed for custody of the minor child and the respondent has also filed his counter. The rights of the parties in the main Original Petition seeking custody of the child can be decided after examination of witnesses.
Considering the nature of relationship and the prayer sought for in this application and since the respondent also fairly conceded to produce the child at any public place, the applicant/mother is permitted to 5/7
visit the minor child on every Saturday between 10.00 a.m. to 1.00 p.m. at Kabaleeswarar Temple, Mylapore, Chennai. The respondent/father is directed to bring the child in the said Temple on every Saturday without fail.
With the above directions, this application stands disposed of. Further in view of the above order, the application in A.No.4108 of 2025 seeking interim custody of the minor child, stands closed. Post the main Original Petition in O.P.No.438 of 2025 before the Master for recording evidence on 05.11.2025. The learned Master is directed to complete the evidence within a period of two months from 05.11.2025 without any long adjournment.
