PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to survey the measurement of petitioner property comprised in survey No 289/10 at measuring to an extent of 0.08 cent patta No.1920 at keelaperambalur village,kunnam taluk,perambalur district, and subsequently issue separate patta in favour of petitioner name on pursuance to petitioner representation dated 03.04.2023.

O R D E R

By consent of both the learned counsel appearing for the petitioner as well as respondents, this writ petition is disposed of at the admission stage itself.

2. The petitioner herein seeks a direction to respondents to survey and issue separate patta in his name in respect of property comprised in Survey No.289/10 measuring an extent of 0.08 cents in Patta No.1920 at Keelaperambalur village, Kunnam Taluk, Perambalur district by considering his representation dated 03.04.2023.

3. According to the petitioner, he purchased the above mentioned property under registered sale deed dated 24.02.2006. Thereafter, he submitted an online application on 23.05.2022 seeking sub-division of the property and the same has not been considered. Hence, the petitioner submitted a representation on 03.04.2023 seeking sub-division of the property and issue of separate patta in his name. Till date, the respondents have not considered the same. Hence, the petitioner is before this Court. 2/4

4. The learned Government Advocate, who is taking notice for the respondents, submitted that the representation of the petitioner will be considered on its' own merits within a time fixed by this Court.

5. In view of the same, without going into the merits of the claim made by the petitioner, the 2nd respondent is directed to consider the representation of the petitioner dated 03.04.2023 and pass final orders on its' own merits within a period of six weeks from the date of receipt of copy of this order.

6. With the above directions, this writ petition is disposed of. No costs. 23.09.2024 Index : Yes/No nr 3/4
