C.M.P.No.21345 of 2019 in C.R.P.SR.No.113790 of 2019 D. KRISHNAKUMAR, J., This Miscellaneous Petition has been filed praying to discharge the first petitioner from legal guardianship for second petitioner and set her at liberty to continue the case on her own.

2. The petitioner/1st defendant has filed the suit in O.S.No.184 of 2012 on the file of the District Munsif Court, Harur, for permanent injunction against the second defendant, now posted for trial and the same was pending. Aggrived by the same, the 2nd defendant filed the suit in O.S.No.210 of 2012 against the first defendant for declaration and permanent injunction and the same was pending.

3. According to the petitioner, the present miscellaneous petition has been filed to discharge the first petitioner from legal guardianship for the second petitioner and set her at liberty to continue the case on her own and she attained the majority as on 23.03.1999. Therefore, he filed the present petition to discharge the legal heir guardianship representing on behalf of the second petitioner.

4. Heard both sides and perused the materials available on record.

5. The respondent has no objection, if this petition is allowed and no prejudice would be caused to the respondents and accordingly, this Miscellaneous Petition is allowed.
