Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, directing the respondents 1 to 5 to take necessary action against the 6th respondent based on the representation of the petitioner dated 28.09.2022 on merits and in accordance with law within a reasonable time as may be determined by this Court. ORDER
This Writ Petition has been filed for a Mandamus seeking for a direction to the respondents 1 to 5 to take necessary action against the sixth respondent based on the petitioner's representation dated 28.09.2022, within a time frame to be fixed by this Court.
2. Heard the learned counsel for the petitioner. Mr.L.S.M. Hasan Fizal, learned Additional Government Pleader, accepts notice on behalf of the respondents. By consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The petitioner is a Sub-Inspector of Police and the sixth respondent 2/6
is an Inspector of Police. Both of them are colleagues.
4. The petitioner claims that there is a caste and gender discrimination committed by the sixth respondent. In such circumstances, she has given a complaint dated 28.09.2022 to the official respondents.
5. It is now brought to the notice of this Court that based on the petitioner's complaint, inquiry proceedings have been initiated and both the petitioner as well as the sixth respondent have been called for inquiry today and the same is recorded.
6. No prejudice will be caused to the respondents if a direction is issued to the fourth respondent to pass final orders on the petitioner's complaint dated 28.09.2022 against the sixth respondent, after holding a proper inquiry and after affording a fair hearing to the petitioner as well as the sixth respondent, within a time frame to be fixed by this Court.
7. For the foregoing reasons, this Court directs the fourth respondent to pass final orders on the petitioner's complaint dated 28.09.2022 against the 3/6
sixth respondent, alleging caste and gender discrimination committed by him who is her superior, after affording a fair hearing to the petitioner as well as the sixth respondent and any other official whom the fourth respondent deems to inquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
8. With the aforesaid directions, this Writ Petition is disposed of. No costs.
