ORDER
The instant writ petition has been filed, challenging the transfer order dated 11.03.2024 by and in which, the petitioner was transferred from Thiruppur Division to Erode Division on Administrative ground.
2. The only contention put forth by the learned counsel appearing on behalf of the petitioner is that the petitioner has got unblemished service and only to wreck vengeance against the petitioner, the 2nd respondent had transferred the petitioner. The learned counsel would further submit that though the transfer order was issued in the year 2024, so far the petitioner has not joined in the transferred place.
3.Per contra, the learned Standing Counsel appearing on behalf of the respondents would strongly object the contention of the petitioner and would submit that the transfer order was issued only on administrative ground. Though the petitioner had made allegations against the 2nd respondent, the officer concerned was not impleaded here in his personal capacity, therefore 2/5
such contentions cannot be adjudicated on the administrative capacity. 4.I have given my anxious consideration on either side submissions. 5.While looking at the transfer order, it was issued on 11.03.2024 on the administrative ground, and after lapse of more than one year, the petitioner has now come forward to challenge the said transfer order, which is hit by the latches and delays. Apart from that, the transfer is the incidents of service and the employer is the best Judge to decide as to where the concerned employee to be posted. Hence, such correct administrative decision is not amendable to the judicial proceedings.
6. Hence the writ petition is dismissed. No costs. Consequently, the connected miscellaneous petitions are also closed. 03.07.2025 ssi Index : Yes Speaking Order : Yes /No To:
