This petition is filed to condone the delay of 459 days in filing the appeal.

Heard Mr.A.Jayamalan, learned counsel for the petitioners, Mr.M.T.Arunan, learned counsel for respondent 1 and Mr.E.Vijay Anand, learned Additional Government Pleader for respondent 2.

Though this petition has been stoutly opposed by Mr.M.T.Arunan, learned counsel for respondent 1 and no objection has been expressed by the learned Additional Government Pleader appearing for respondent 2, we, having satisfied with the reasons stated for such delay, which is found in paragraph 23 of the affidavit filed in support of this petition, are inclined to accept the same and accordingly, this petition is ordered.
