This Miscellaneous Petition has been filed to set aside the exparte order made against the respondents 1 and 2 on 07.08.2024 in the above Writ Petition.
2. The first respondent has filed an affidavit in this Miscellaneous Petition stating that in view of the confusion caused in engaging the counsel, it was omitted to be represented on the designated day.
3. However, the learned counsel for the petitioner in the Writ Petition submitted that the first respondent is in the habit of making delaying tactics at every stage of the proceedings.
4. Though the delay making is a matter of concern, in the instant case, it appears that the first respondent has filed a petition to setaside the exparte order shortly after he came to know about the exparte order. In the interest of justice, an opportunity should be granted to the first respondent to come before this Court to advance his arguments. https://www.mhc.tn.gov.in/judis

5. In view of the same, this Miscellaneous Petition is allowed and the order passed on 07.08.2024 against the first respondent is set aside. The interim stay, if any, already granted shall stand extended till 27.09.2024.
