This petition is filed under Section 378 (4) Cr.P.C, to grant leave and permit the petitioner to prosecute the above appeal filed against the order of acquittal dated 28.08.2023 made in C.C.No.172/2022 on the file of the Fast Track Court No.1, Judicial Magistrate, Coimbatore.

2. Heard Mr.R.Bharath Kumar, learned counsel for the petitioner.

3. Learned counsel for the petitioner contended that though the accused admitted his signature on the cheque, the trial court had acquitted the accused on the ground that the complainant had not filed his Income Tax Returns even though he is a money lender. According to him, there are arguable points in the present appeal and prayed for allowing this petition.
