Respondents Prayer : Civil Revision Petition filed under Article 227 of the Constitution of India, to direct the learned Subordinate Judge, Kangeyam, to expedite the trial and dispose of O.S.No.170 of 2020 within a time frame that may be fixed by this Court.

O R D E R

The petitioner is a 94 years old gentleman. He had instituted a suit for declaration and injunction in O.S.No.170 of 2020, before the Subordinate Judge, Kangeyam.

2. I had called for a report from the learned Subordinate Judge, Kangeyam and he has sent a report on 16.10.2024 stating that O.S.No.170 of 2020 is ready for trial. He has pointed out that there are about 1804 cases pending, of which 215 cases have been presented before the present suit.

3. While I am able to appreciate the difficulty of the learned Subordinate Judge, considering the fact that the plaintiff is 94 years old, priority should be given, since the party is not only a senior citizen, but an nonagenarian. Therefore, in the interest of the parties as well as the Court that the litigant who is aged about 94 years sees the end of his litigation during his lifetime.

4. Taking over all circumstances, there shall be a direction to the learned Subordinate Judge, Kangeyam to dispose of the suit in O.S.No.170 of 2020 within a period of six months from the date of receipt of a copy of this order.

5. With the above direction, this Civil Revision Petition stands disposed of. No costs.
