Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents police 1 and 2 to take action on the complaint of the petitioner dated 05.09.2019 and get back the said Mahendra 595 Tractor bearing registered No. TN 77 H 6672 from the 3rd respondent and hand over to the petitioner.

ORDER

This Criminal Original Petition has been filed to direct the respondents 1 and 2 to take action on the complaint of the petitioner dated 05.09.2019 and get back the said Mahendra 595 Tractor bearing registered No.TN 77 H 6672 from the 3rd respondent and hand over to the petitioner.

2. The learned counsel for the petitioner requests to post the matter on some other day.

3. The learned Additional Public Prosecutor has submitted that this petition has been filed to direct the respondents 1 and 2 to take action on the complaint of the petitioner dated 05.09.2019. He further submitted that after receipt of the petitioner's complaint, CSR.No.296 of 2019 was issued and after enquiry, the said complaint was closed on 14.10.2019 and hence, this petition has become infructuous.

4. Considering the submission made by the learned Additional Public Prosecutor, this petition is closed. It is open to the petitioner to avail any other remedy which is available under the law.
