Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Mandamus, directing the Respondents to permit the Petitioner to put up the construction in the allotted property situated in Plot No. B-1 in the Sipcot's Industrial Complex at Nilakottai within the Village limits of Pallapatty, Nilakottai Taluk, Dindigul District totally to an extent of 5.00 acres by considering the Petitioner's representation dated 28.09.2016.

Heard Ms. Sudharsana Sundar, Learned Counsel appearing for the Respondents and perused the materials placed on record, apart from the pleading of the parties.

Though the matter has been posted under the caption 'for dismissal', there was no representation for the Petitioner when the matter was called at 11.39 a.m. today, apart from the earlier hearing on 30.10.2023. 3.

It has been brought to notice that the Petitioner had earlier filed the Writ Petition in W.P. No. 19632 of 2016 challenging the Proceedings in 2/5

No.DI/NLK/IACTL/2010 dated 24.08.2015 passed by the First Respondent cancelling the allotment of the industrial plot of an extent of 5.00 acres in Plot No. B-1 in SIPCOT Industrial Complex, Pallapatty, Nilakottai Taluk, Dindigul District that had been allotted to it and for consequential direction to restore the allotment so as to enable it to put up construction in that property, which has been dismissed by an order dated 08.11.2022. Consequently, the relief sought in this Writ Petition to dispose its representation to put up construction in the property cannot be granted.

In the result, the Writ Petition is dismissed. No costs. 31.10.2023 Index: Yes/No NCC: Yes/No Note: Issue order copy by 22.05.2024.
