O R D E R

This application has been filed by the Chennai Metropolitan Water Supply and Sewerage Board seeking for payment out of a sum of Rs.2,93,40,000/- along with interest lying in the credit of Arb.O.P.(Comm.Div.) No.162 of 2021.

2. Heard the learned counsel for the applicant and perused the materials available on record.

3. The main petition viz., Arb.O.P.(Comm.Div.) No.162 of 2021 was disposed of by an order dated 16.06.2025 and for proper appreciation, the order is extracted hereunder :

"Both the parties have arrived at an amicable settlement. The same is confirmed through the submissions made by the respective counsels before this Court, today. Both the counsels have also filed a copy of the Memorandum of Understanding, dated 10.06.2025 signed by both the parties supported by a Memo filed by the learned counsel for the petitioner.

2. The learned counsel for the respondent also submits that in view of the settlement arrived at between the parties, the agreed amount has been paid and the Award can be set aside.

3. Accordingly, this Court after recording the terms of settlement is setting aside the impugned Arbitral Award, dated 20.04.2020 followed by the revised Arbitral Award, dated 01.06.2020. 2/4

4. In terms of the Memorandum of Understanding, dated 10.06.2025 entered into between the parties to the dispute, this petition is disposed of. No costs. The Memorandum of Understanding, dated 10.06.2025 shall form part of this order."

4. In the light of the above development, there cannot be any objection in permitting the applicant to withdraw the amount lying in the credit of Arb.O.P.(Comm.Div.) No.162 of 2021 along with accrued interest. Accordingly, this application is ordered as prayed for. 19.09.2025 gya 3/4
