Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the 2nd respondent to defreeze the petitioner's saving bank account no.6683537056 holding with Indian Bank Peelamedu Branch, Coimbatore District (3rd respondent herein) based on the petitioner's representation dated 28.8.2023 forthwith.

ORDER

This writ petition has been filed for a direction to the 2nd respondent to defreeze the savings bank account of the petitioner maintained in the 3rd respondent Bank.

2.The grievance of the petitioner is that her bank account in the 3rd respondent Bank was freezed by the respondent police on 13.10.2022. 3.The learned Additional Public Prosecutor on instructions submitted that freezing of the bank account was done on 13.10.2022 in the course of investigation in Crime No.920 of 2022. However, the mandate u/s.102 Cr.PC., was not followed.

4.In the light of above submission, there shall be a direction to the 2nd respondent, to defreeze the bank account of the petitioner maintained in the 3rd respondent bank. If the 2nd respondent wants to freeze the bank account of the petitioner in the course of investigation, the mandate u/s.102 Cr.PC., has to be necessarily followed.
