ORDER

This petition is filed with a prayer not to harass the petitioner. 1/4

When the matter came up for hearing, the learned Government Advocate (Criminal Side) appearing for the respondents would submit that a warrant of arrest has been issued against the petitioner by the Judicial Magistrate, 8th Court, Calcutta in Case No.CS/283808/2024, which appears to relate to an offence under Sections 316(2)/318/351 of Bharat Nyaya Sanhita, 2023. Therefore, the petitioner is being searched by the police.

In reply thereof, Mr.M.Shreedhar, the learned counsel appearing for the petitioner, submitted that under the guise of executing the warrant, the police are insisting that the petitioner settle the entire amount with the complainant, which liability is disputed by the petitioner. He further contended that the petitioner has a right to contest the case. As a matter of fact, there cannot be any jurisdiction for the Courts at Kolkata at all as the entire cause of action arose within Chennai alone.

5. I have considered the rival submissions made on either side and perused the material records of the case.

6. As a warrant of arrest has been issued and it has been stated that the police are looking for the petitioner only for execution of the said warrant, the 2/4

submission made by the learned Government Advocate (Criminal Side) that the action is not for enforcing a settlement but only for executing the warrant is recorded.

7. As far as the grievance expressed by the petitioner is concerned, it is open to the petitioner to take appropriate steps against the said warrant of arrest in the manner known to law.

8. Recording the above, the Criminal Original Petition stands disposed of.
