C.M.P.No.20102 of 2022 in S.A.No.489 of 2011 P.T.ASHA, J., This petition is filed to condone the delay of 203 days in filing the petition for restoration of above Second Appeal in S.A.No.489 of 2011, which was dismissed for non-prosecution on 24.08.2021.

2. Heard the learned counsel for the petitioners/appellants.

No representation for the respondent, though the matter was called twice.

3. On the last occasion, i.e.,02.01.2023, this Court directed the petitioners to file a better affidavit, which has been filed today.

4. Considering the fact that sufficient reasons have been given in the affidavit filed in support of the petition, the delay is condoned and the petition is allowed.

5. The Registry is directed to number the petition, if it is otherwise in order and list the same for hearing.
