ORDER
The petitioner who apprehends arrest for the alleged offences under Sections 3(2)(b), 4(1), 4(2)(c) of Immoral Traffic (Prevention) Act, 1956 in in Crime No. 367 of 2025 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the accused are engaging in prostitution with women under the name of SPA. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he is not involved in the offence. He is only a watchman and aged about 76 years old. The petitioner has been falsely implicated in this case. The petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.
4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that there are 3 accused in this case. A2 and A2 are the owner and Manager of the SPA and they have been arrested and 2\6
released on bail. The investigation is also completed. The victim also rescued. Hence, he vehemently opposed to grant bail to the petitioners. 5.Considering the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. 6.Accordingly, the petitioner is directed to deposit a sum of Rs.10,000/- by way of Demand Draft/RTGS/NEFT to "The Registered Advocate Clerk Association, Dharapuram", without prejudice to his rights and contentions before the trial Court, on such deposit and production of proof, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Dharapuram, on condition that the petitioner shall execute a bond for a sum of Rs.
copy of their Aadhar Card or Bank pass Book to ensure their identity; (b)The petitioner shall report before the respondent police on every Saturday at 10.30 a.m. for a period of eight weeks and thereafter, as and when required for further interrogation;
(c)the petitioner shall not tamper with evidence or witness either during investigation or trial;
(d)the petitioner shall not abscond either during investigation or trial; (e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (f)if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
