Crl.M.P.No.15083 of 2023 in Crl.O.P.No.10771 of 2023 SUNDER MOHAN,J.

This petition seeks modification of the condition imposed by this Court in Crl.O.P.No.10771 of 2023 dated 10.05.2023 mainly on the ground that the learned Special Judge for EC/NDPS Act cases, Salem had rejected the surety furnished by the petitioner.

2. This Court is of the view that the condition cannot be modified, even assuming that the learned Special Judge for EC/NDPS Act cases, Salem, rejected the surety erroneously.

3. Accordingly, the Criminal Miscellaneous Petition is dismissed.

However, it is open to the petitioner to challenge the order rejecting the surety offered by him.
