Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2nd respondent to consider the representation of the petitioner dated 20.05.2019 with regard to grand of the benefits of incentive increment as per G.O.Ms.No.83, School Educational Department dated 28.04.2017 and disburse the monetary benefits thereof.

The prayer sought for in this Writ Petition is to direct the 2nd respondent to consider the representation of the petitioner

dated 20.05.2019 with regard to grand of the benefits of incentive increment as per G.O.Ms.No.83, School Educational Department dated 28.04.2017 and disburse the monetary benefits thereof.

2. The case of the petitioner is that he was initially appointed as Secondary Grade Teacher in Kalyanasundram Primary School, Thanjavur on 02.02.1999. This School is a Government Aided recognized Private School. The petitioner was declared to have satisfactorily completed the period of probation on 17.04.2001. The petitioner studied higher degree course in M.A (Economics), through Annamalai University, Chidambaram. The petitioner had passed the examination in the year 2018 and the provisional Degree certificate was entered in his service Register. For the purpose of availing incentive increments as per G.O.Ms.No.83, School Education Department dated 28.04.2017, the petitioner made a representation on 20.05.2019 to the 2nd respondent, however, till date the said representation was not considered. Therefore, the Writ Petition has been filed.

3. The learned counsel for the petitioner would submit that it would be suffice to issue direction to the 2nd respondent to dispose of the representation dated 20.05.2019 in accordance with law.

4. Considering the facts and circumstances of the case and the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the 2nd respondent to dispose of the representation dated 20.05.2019, if not disposed already, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
