The petitioner herein alleging that, her representation dated 12.07.2023 against one G.Manikandan, not been acted upon by the 3rd respondent police is before this Court, seeking appropriate direction.

2. On notice, the Learned Government Advocate (Crl.Side) for the respondent Nos.1 to 3 submitted that, on 02.11.2023 when the defacto complainant was called and enquired, she has given a letter to withdraw the case. However, the Learned Counsel appearing for the petitioner submitted that the complaint was given on 17.07.2023, no action taken by the Police. Only after Writ Petition filed before this Court, notice was issued to the Station House Officer, Kaveripakkam, to direct him to file Status Report on 08.11.2023, the petitioner was called to the Police Station and by force, letter was obtained. Page No.2/4

3. This Court finds that just to avoid filing the status report which will expose their inaction on acting upon the complaint given by the petitioner, the 3rd respondent had called the petitioner herein and had obtained the letter as if, she is not interested in perusing the case. Hence, the 2nd respondent/D.S.P., Arakkonam, is directed to order register of the complaint dated 17.07.2023 and change the Investigating Officer and complete the investigating within period of 60 days.

4. With the above direction, this Writ Petition is disposed of. No costs.
