ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 82(1), 85 of BNS, Act, 2023 altered into 82(1), 85, 296(b), & 351(1) of BNS Act, 2023, in Crime No.12 of 2025, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant and A1 are husband and wife. A1 had done bigamous marriage with one A6. On questioning the same, A1 along with other accused alleged to have attacked the defacto complainant by using unparliamentary words and affirmed that A1 would not live with the defacto complainant. Hence, the case. 3.When this Court heard the item No.148 today's list, the learned Government Advocate (Crl.side) brought to the knowledge of this Court that the petitioner /A1 in Crl.O.P.

No21790 of 2025 got married with A6, pending divorce proceedings and so far the 1 st marriage with the defacto complainant has not been dissolved. Therefore, this Court is inclined to recall the earlier order dated 11.092025 made in Crl.O.P.No.21790 of 2025. In view of the same, interim bail was granted with the condition that A1 is directed to go for Mediation and Conciliation Centre, Coimbatore, not less than three sitting. 4.Both the parties are directed to appear before the Mediation and Conciliation Centre, Coimbatore on 17.09.2025.

Advocate (Crl.side) is directed to inform the defacto complainant to go for Mediation.

Considering the facts and circumstances of the case, this Court is inclined to grant interim anticipatory bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy is made ready, before the Judicial Magistrate, Additional Mahila Court, Coimbatore, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that:

[a] the petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] the petitioner shall report before the respondent police every Saturday at 10.30 a.m, until further orders.

[c] the petitioner shall not tamper with evidence or witness either during investigation or trial;

[d] the petitioner shall not abscond either during investigation or trial. [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the Petitioners in accordance with law as if the conditions have been imposed and the Petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
