The petitioners, who are arrayed as accused 1 to 3, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 294(b), 323 and 506(i) of IPC r/w Section 4 of the Prohibition of Harassment of Women Act,2002, in Crime No.218 of 2016 on the file of the respondent police and hence, seek anticipatory bail.

2. According to the defacto complainant, she is a member of Self Help Group, in which, the second petitioner is a leader. Since the second petitioner did not properly maintain the account, the same was questioned by the defacto complainant and thereby a quarrel arose between them and the petitioners said to have attacked the defacto complainant in a public place and torn off her clothes.

3.The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case.

4. The learned counsel appearing for the intervenor vehemently opposed this petition and contending that the defacto complainant is a lady and she was attacked by the accused in a public place and she was insulted in the presence of the general public.

5. Heard the learned Government Advocate (Criminal side) appearing for the respondent.

6. Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

7. Accordingly, the petitioners are ordered to be released on bail in the event of their arrest or on their appearance before the learned Judicial Magistrate No.I, Pollachi, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners 1 and 3 shall appear before the respondent police daily at 10.00 am., until further orders and the 2nd petitioner is being a lady shall appear before the respondent police as and when required for interrogations. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. rrg 2 6. 0 4. 2 0 1 6
