PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents authorities to pay the medical expenses with interest by disposing of the petitioner's representation dated 03.09.2022 within such time as may be stipulated by this Court. ORDER
The present writ petition has been filed seeking a direction to respondent authorities to pay medical expenses with interest by disposing of petitioner's representation dated 03.09.2022, within a time frame to be fixed by this Court.
2. At the outset, it was submitted by learned Standing Counsel for respondents 1 to 3 that claim of petitioner was sent to the District Treasury Officer, Coimbatore District vide second respondent letter No.1286/2014 Pa 2 dated 24.01.2018 and followed by reminders, however, District Treasury Officer, Coimbatore District, has not passed any order.
3. At this juncture, to avoid uncertainty, it was submitted by learned counsel for petitioner that they may be granted liberty to submit a fresh representation before the District Treasury Officer, Coimbatore District, agreed to by the learned Standing Counsel for respondents 1 to 3.
4. Since District Treasury Officer, Coimbatore District, is appropriate authority to consider representation of petitioner, this Court suo motu impleads District Treasury Officer, Coimbatore District as fifth respondent in this present writ petition.
5. In view of limited relief that is prayed, this court is inclined to dispose of the writ petition with following directions: i) It is open to petitioner to submit a fresh representation before District Treasury Officer, Coimbatore District, within a period of two weeks from the date of receipt of a copy of this order.
ii) On such representation being made, District Treasury Officer/appropriate authority shall consider and pass orders in accordance with law, on petitioner's representation, after affording petitioner an opportunity of hearing, within a period of four weeks thereafter.
